Abstract

Enforcement or Negotiation presents a study of the development and operations of the federal Office of Surface Mining Reclamation and Enforcement during its first four years (1978-82), with special emphasis on the issue of regulatory enforcement. It examines the causes and consequences of the agency's change from an enforced compliance style of regulation toward a more discretionary negotiated compliance .The analysis is grounded in a variety of methods, including personal interviews, examination of archival data, and structured questionnaires. A comparative analysis of how the legislation was implemented differently in two regions of the United States demonstrates the crucial importance of local conditions on the implementation of regulatory mandates. The OSM's efforts to balance demands for equity and efficiency are documented, as well as the differences in oppositional strategies employed by large and small mining companies.

Abstract

The future of mining in South Africa is hotly contested. Wide-ranging views from multiple quarters rarely seem to intersect, placing emphasis on different questions without engaging in holistic debate. This book aims to catalyse change by gathering together fragmented views into unifying conversations. It highlights the importance of debating the future of mining in South Africa and for reaching consensus in other countries across the mineral-dependent globe. It covers issues such as the potential of platinum to spur industrialisation, land and dispossession on the platinum belt, the roles of the state and capital in mineral development, mining in the era of the Fourth Industrial Revolution, the experiences of women in and affected by mining since the late 19th century and mine worker organising: history and lessons and how post-mine rehabilitation can be tackled. It was inspired not only by an appreciation of South Africa's extensive mineral endowments, but also by a realisation that, while the South African mining industry performs relatively well on many technical indicators, its management of broader social issues leaves much to be desired. It needs to be deliberated whether the mining industry can play as critical a role going forward as it did in the evolution of the country's economy.

Abstract

Proposals for more effective natural resource governance emphasise the importance of institutions and governance, but say less about the political conditions under which institutional change occurs. 'Governing Extractive Industries' synthesises findings regarding the political drivers of institutional change in extractive industry governance. It analyses resource governance from the late 19th century to the present in Bolivia, Ghana, Peru and Zambia, focusing on the ways in which resource governance and national political settlements interact.

Abstract

L'Antarctique, continent jadis oublié, est devenu un sujet de premier ordre dans le contexte actuel des relations internationales. Aux préoccupations juridiques, politiques et stratégiques se sont jointes par la suite les préoccupations économiques, notamment celles concernant l'exploration et l'exploitation des ressources minérales. Le silence du Traité sur l'Antarctique à cet égard a posé le problème de l'approche à suivre pour combler cette lacune, source potentielle de conflits dans la région. Il a fallu harmoniser aussi bien les intérêts des pays possessionnés que ceux des pays non possessionnés, sans perdre de vue, en même temps, les intérêts de la Communauté internationale. Le résultat de ces accommodements a été la Convention sur la Réglementation des activités relatives aux ressources minérales de l'Antarctique du 2 juin 1988, instrument qui est analysé en détail par l'auteur. La Convention, négociée dans la difficile complexité antarctique et dans une atmosphère de confrontation Nord/Sud et Sud/Sud, constitue un vrai défi pour la continuité du système. C'est dans ce contexte que certains pays en développement ont mené la bataille pour accorder à l'Antarctique le statut de « patrimoine commun de l'humanité ». Cet instrument représente l'un des meilleurs textes juridiques élaborés jusqu'à nos jours. Les intérêts économiques des Parties consultatives n'ont pas empêché une réelle préoccupation pour la protection de l'environnement et les intérêts de la Communauté internationale. L'équilibre ainsi réussi est tout à fait remarquable.
